§ 98-156. Evaluation of employee's mental or physical fitness.

  • The chief of corrections is authorized to order an employee of the department of corrections to submit to an evaluation of the employee's mental or physical fitness for duty, when there is an articulable basis to suspect that an employee may be physically or mentally impaired. If such an evaluation reveals possible impairment, the chief may make whatever administrative reassignment deemed necessary by the chief and seek approval from the commissioner of personnel and human resources and the chief operating officer to invoke the disability process set forth in chapter 114, article IV, division 12 of this Code pertaining to the civil service rules and regulations.
