Any person who shall, by the erection of a dam or other obstruction, prevent the natural
flow of water, causing it to collect in pools upon any lot or in any street or alley,
or who shall allow any such dam or obstruction to continue on any property owned or
controlled by such person, after knowledge of its existence, or who shall do or cause
to be done any work the effect of which will be to cause the damming up or collection
of water in pools, shall be guilty of the offense of maintaining a nuisance, and such
action shall be unlawful; provided, however, that this section shall not prevent persons
owning or controlling property from filling up such lots as they may desire, if sufficient
drainage is provided across such lots for such natural flow; provided, further, that
this section shall not prevent such change of the grade of any street as may be for
the public interest.
