§ 62-39. Assessment of costs and jail fees against prosecutors in dismissal for want of probable cause.

(a)
A municipal court judge may, in the discretion of the judge, assess costs and jail
fees against the person who initiated the prosecution when, at a criminal proceeding
for a violation of this Code or other ordinance of the city, the action is dismissed
for want of probable cause or for want of prosecution. This subsection shall not apply
to law enforcement personnel or any other city employee acting in an official capacity.
(b)
Assessment costs and jail fees imposed by a municipal court judge in this article
shall not exceed $300.00.
