§ 30-1466. Penalties.

  • Any person violating any of the provisions of this article shall, upon conviction thereof, be punished as follows:

    (1)

    First conviction. A fine of not less than $100.00 nor more than $1,000.00 and costs or imprisonment in the city jail for not more than 60 days or both.

    (2)

    Second conviction. A fine of not less than $200.00 nor more than $1,000.00 and costs or imprisonment in the city jail for not more than 60 days or both.

    (3)

    Third conviction. A fine of not less than $500.00 nor more than $1,000.00 and costs or imprisonment in the city jail for not more than 60 days or both.

    (4)

    Fourth conviction. Any person convicted of four or more violations of this article within any 12-month period shall be subject to a fine of not less than $500.00 nor more than $1,000.00 and costs or imprisonment in the city jail for not more than 60 days or both; and a court-ordered referral shall be forwarded to the chief of police for revocation of their permit.
