§ 22-115. [Loitering prohibited.]
(a)
It shall be unlawful for any person to loiter in any waiting room, hold room, lobby, concourse, terminal or any other portions of the airport.
(b)
It shall be unlawful for any person to use or remain in the airport for the purpose of lodging. As used in this section lodging means to sleep or remain for a period of time in any public area of the airport for the purpose of sleeping or using the airport for temporary accommodations except in a hotel located on the airport premises or except in the case of severe weather, delays in flights or flight equipment problems or other conditions causing disruption to airport activity which are beyond the control of the airport wherein such person is a ticketed passenger and is caused to remain at the airport. Notwithstanding the prohibition contained in this subsection, the aviation general manager may declare an emergency and suspend the operation of this subsection (b).
(c)
Nothing in this section shall be deemed to prohibit any persons from occupying such airport for the purpose of meeting or greeting arriving and departing passengers, or otherwise prohibiting persons with legitimate reasons from remaining on said premises. As used herein the term "legitimate reasons" shall mean but is not limited to being on airport premises for the purpose of shopping or dining at the airports shops or restaurants or observing arriving and departing aircraft in areas permitted by airport tenants or any other area designated, or to be designated for such purpose, by the aviation general manager.
(d)
Unless flight by the person or other circumstances make it impractical, prior to any arrest for an offense under this section a law enforcement officer shall:
(1)
Afford the person the opportunity to explain their presence or dispel the alarm or immediate concern for the safety of persons or property in the vicinity of such person, and
(2)
Upon failure of such person to explain their presence in accordance with paragraph (c) above, advise the person that this section prohibits loitering and lodging at the airport as described herein, and afford the person the opportunity to leave the premises.
(e)
Violations of this offense shall be punishable as set forth in code of ordinance section 1-8.
