Vacancies in the classified service shall normally be filled from eligible lists resulting
from open competitive examinations, unless the department head should determine that
such vacancies should be filled by transfer, promotion, demotion, reassignment or
through any other authorized and established noncompetitive process. Decisions not
to use open competitive examinations shall be approved by the commissioner of human
resources, except that if the department head and commissioner of human resources
disagree, the mayor shall make the final decision.
