§ 10-114. Active participation in licensed premises by licensee; transfer of right to operate.

  • (a)

    For the purposes of this section, the term "active participation" means direct control or supervision over the employees and location of the premises licensed under this division.

    (b)

    Every individual person granted a license for the sale of alcoholic beverages under this division shall maintain an active participation in the operation of the licensed premises during the term of the license. For a corporation, partnership or association issued a license for the sale of alcoholic beverages, the individual agent named in the application for the license shall maintain an active participation in the operation of the licensed premises during the term of the license.

    (c)

    No licensee or agent of any licensee shall transfer the right to operate under any license to any other person by lease, agreement, contract or any other agreement.
