§ 106-10. Distribution of free tobacco products in public places prohibited.

  • (a)

    Generally. In order to avoid obstruction and congestion of public ways and places, to protect pedestrians from annoyance and invasion of privacy, to avoid litter and to avoid facilitating the availability of cigarettes or other tobacco or smoking products to minors, no person in the business of selling or otherwise distributing cigarettes or other tobacco or smoking products for commercial purposes, or any agent or employee of any such person, shall, in the course of such business, distribute any cigarettes or other tobacco or smoking products free to any person on any public street or sidewalk, or in any park or playground, or any other public ground, or in areas open to the public in any publicly-owned or -operated building.

    (b)

    Violation. Any person who violates the provisions of subsection (a) of this section shall be punished by a fine of not less than $20.00 nor more than $50.00 for each violation. Every hour or part thereof in which a person engages in such conduct shall constitute a single and separate violation.
